Chesspin Kullanım Koşulları

Bu koşullar, chesspin.app adresinde ve Chesspin mobil uygulamasında sunulan Chesspin satranç hizmetinin ("Hizmet") kullanımını düzenler. Hizmet, Mustafa ALIN ("Chesspin", "biz") tarafından gerçek kişi olarak sunulmaktadır. Hizmet'i hesap açarak ya da hesap açmadan (misafir olarak) kullandığınızda bu koşulları kabul etmiş olursunuz. Kabul etmiyorsanız Hizmet'i kullanmayın.

1. Hizmet

Hizmet ücretsizdir. Bilgisayar rakiplerine karşı oyun, başka oyuncularla online ve davetli oyun, puanlı eşleşme, bulmacalar, XP ve oyun incelemesi gibi özellikler sunar. Hizmet'i geliştirmek için özellikleri değiştirebilir, ekleyebilir veya kaldırabiliriz. Hizmet'in kesintisiz ya da hatasız çalışacağını garanti etmeyiz; bakım, arıza veya altyapı sağlayıcılarından kaynaklanan kesintiler olabilir.

Mobil uygulamayı bir uygulama mağazasından indirdiyseniz, o mağazanın kendi kullanım şartları da geçerlidir.

2. Yaş sınırı

Hizmet 13 yaş ve üzerindeki kişiler içindir. 13 yaşından küçükler hesap açamaz; 13 yaşından küçük bir kişiye ait olduğunu öğrendiğimiz bir hesap silinir. 18 yaşından küçükseniz Hizmet'i velinizin bilgisi dâhilinde kullanmalısınız.

3. Hesabınız

• Hesap açarken doğru ve size ait bir e-posta adresi vermelisiniz.
• Hesabınız kişiseldir; başkasına devredilemez, satılamaz veya başkasıyla ortak kullanılamaz. Parolanızın gizliliğinden siz sorumlusunuz. Hesabınızın izinsiz kullanıldığını düşünüyorsanız parolanızı değiştirin ve bize bildirin.
• Puanlı oyunlarda yalnızca bir hesapla oynayabilirsiniz.
• Kullanıcı adınız herkese açıktır. Başka bir kişiyi, kurumu veya Chesspin'i taklit eden; hakaret, nefret söylemi, müstehcenlik ya da reklam içeren veya başkasının haklarını ihlal eden kullanıcı adları kullanılamaz. Böyle bir kullanıcı adını değiştirebiliriz.

4. Adil oyun

Başka bir insana karşı oynanan oyunlarda ve puan, XP veya sıralama doğuran her işlemde şunlar yasaktır:

• oyun sırasında satranç motorundan, başka bir yazılımdan, kitaptan veya başka bir kişiden yardım almak;
• puanı veya sıralamayı yapay olarak değiştirmek: kasıtlı kaybetmek, sonucu rakiple önceden ayarlamak, birden fazla hesapla kendi kendine oynamak;
• bulmaca çözümlerini veya XP'yi otomatik araçlarla ya da Hizmet'teki bir hatayı kullanarak elde etmek;
• Hizmet'in güvenliğini aşmaya çalışmak, başka bir oyuncunun hesabına veya misafir tanımlayıcısına erişmek, Hizmet'e otomatik araçlarla aşırı istek göndermek veya işleyişini bozmak.

Bilgisayar rakiplerine karşı oyunlar ve oyun incelemesi pratik içindir; bitmiş bir oyunu analiz etmek serbesttir.

Hizmet'te bir güvenlik açığı bulursanız onu kullanmak yerine bize bildirin.

5. Puanlar, XP ve yıldızlar

Chesspin puanları yalnızca bu Hizmet'e özgüdür; FIDE'nin veya herhangi bir satranç federasyonunun resmî derecesi değildir. Bilgisayar rakiplerinin gücü bir tahmindir. Puanların, XP'nin, yıldızların ve sıralamadaki yerin parasal bir değeri yoktur; satılamaz, devredilemez ve hiçbir şeyle değiştirilemez. Hatalı hesaplanan veya bu koşullara aykırı biçimde elde edilen puan, XP ve sıralamaları düzeltebilir ya da silebiliriz.

6. Oyun kayıtları ve herkese açık bilgiler

Oynadığınız oyunlar Hizmet'te saklanır. Hesap açtıysanız kullanıcı adınız, puanlarınız ve son oyunlarınız herkese açık profilinizde ve sıralamada görünür. Oyunlarınızın hamle kayıtlarının rakibinize gösterilmesini, Hizmet'te incelenmesini ve PGN olarak dışa aktarılmasını kabul edersiniz. Kişisel verilerinizin nasıl işlendiği Aydınlatma Metni'nde açıklanmıştır.

7. Fikri mülkiyet

Chesspin adı ve logosu, karakterler (Asude, Bobby, Hüma, David, Tuğba, Mustafa ve diğerleri), görseller, metinler ve Hizmet'in tasarımı bize aittir. Hizmet'i kişisel ve ticari olmayan amaçla kullanmanız için size sınırlı, devredilemez bir kullanım izni verilir; bu izin bunların kopyalanmasını, satılmasını veya başka bir üründe kullanılmasını kapsamaz.

Hizmet, kendi lisanslarıyla dağıtılan açık kaynak bileşenler içerir: satranç motoru Stockfish (GPL-3.0), Lichess bulmaca veritabanı (CC0) ve taş çizimleri bunlardandır. Bu bileşenler için kendi lisansları geçerlidir ve bu koşullar o lisansların size tanıdığı hakları kısıtlamaz. Liste chesspin.app/lisanslar sayfasında ve mobil uygulamada Ayarlar → Açık kaynak lisansları ekranındadır.

8. Kurallara aykırılık

Bu koşullara aykırı davranılması hâlinde, aykırılığın ağırlığına göre uyarabilir, kullanıcı adını değiştirebilir, puan ve XP'yi düzeltebilir, puanlı oyunlara katılımı kısıtlayabilir, hesabı geçici olarak askıya alabilir veya kapatabiliriz. Bir kararın hatalı olduğunu düşünüyorsanız kvkk@chesspin.app adresine yazabilirsiniz.

9. Hesabın kapatılması ve Hizmet'in sona ermesi

Hesabınızı istediğiniz zaman, mobil uygulamada Ayarlar → Hesap bölümünden veya sitedeki Hesap sayfasından silebilirsiniz; nelerin silinip nelerin kaldığı Hesabını silmek sayfasında anlatılmıştır. Hizmet'i tamamen sona erdirmeye karar verirsek bunu makul bir süre önceden Hizmet içinde duyururuz.

10. Sorumluluk

Hizmet ücretsiz ve "olduğu gibi" sunulur. Kanunun izin verdiği ölçüde; Hizmet'teki kesintilerden, oyunların bağlantı sorunları nedeniyle süre veya sonuç kaybıyla bitmesinden, misafir olarak cihazda tutulan ilerlemenin uygulama kaldırıldığında ya da tarayıcı verileri silindiğinde kaybolmasından ve diğer oyuncuların davranışlarından sorumlu değiliz. Kastımız veya ağır kusurumuzla verdiğimiz zararlardan sorumluluğumuz ile tüketici olarak kanundan doğan haklarınız saklıdır.

11. Değişiklikler

Bu koşulları Hizmet değiştikçe güncelleyebiliriz. Güncel metin her zaman bu sayfada yayımlanır ve başındaki tarih son güncellemeyi gösterir. Önemli değişiklikleri yürürlüğe girmeden önce Hizmet içinde duyururuz. Değişiklikten sonra Hizmet'i kullanmaya devam etmeniz yeni koşulları kabul ettiğiniz anlamına gelir; kabul etmiyorsanız hesabınızı silebilirsiniz.

12. Uygulanacak hukuk

Bu koşullar Türkiye Cumhuriyeti hukukuna tabidir. Tüketici olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun kapsamında tüketici hakem heyetlerine ve tüketici mahkemelerine başvurma hakkınız saklıdır.

These terms govern the use of the Chesspin chess service offered at chesspin.app and in the Chesspin mobile app (the "Service"). The Service is provided by Mustafa ALIN, a private individual ("Chesspin", "we"). By using the Service, with an account or without one (as a guest), you accept these terms. If you do not accept them, do not use the Service.

1. The Service

The Service is free. It offers games against computer opponents, online and invitation games against other people, rated matchmaking, puzzles, XP and game review. We may change, add or remove features to improve it. We do not guarantee that it will run without interruption or error; maintenance, faults or our infrastructure providers can cause outages.

If you installed the mobile app from an app store, that store's own terms apply as well.

2. Age

The Service is for people aged 13 and over. Children under 13 may not create an account, and an account we learn belongs to a child under 13 is deleted. If you are under 18, use the Service with your parent's or guardian's knowledge.

3. Your account

• Give an email address that is correct and yours when you create an account.
• Your account is personal: it may not be transferred, sold or shared. You are responsible for keeping your password secret. If you think somebody else is using your account, change your password and tell us.
• You may play rated games with one account only.
• Your username is public. Usernames that impersonate another person, an organisation or Chesspin, that are insulting, hateful, obscene or advertising, or that infringe somebody else's rights are not allowed. We may change such a username.

4. Fair play

In games against another person, and in anything that earns a rating, XP or a ranking, you may not:

• take help from a chess engine, other software, a book or another person during the game;
• manipulate a rating or ranking: losing on purpose, arranging a result with your opponent, or playing yourself from more than one account;
• obtain puzzle solutions or XP with automated tools or by exploiting a fault in the Service;
• try to get around the Service's security, access another player's account or guest identifier, send the Service excessive automated requests, or disrupt how it works.

Games against computer opponents and game review are for practice; analysing a finished game is fine.

If you find a security flaw in the Service, report it to us instead of using it.

5. Ratings, XP and stars

Chesspin ratings belong to this Service; they are not an official rating from FIDE or any chess federation. A computer opponent's strength is an estimate. Ratings, XP, stars and leaderboard places have no monetary value, and cannot be sold, transferred or exchanged for anything. We may correct or remove ratings, XP and rankings that were calculated wrongly or obtained against these terms.

6. Game records and public information

The games you play are stored by the Service. If you have an account, your username, ratings and recent games appear on your public profile and on the leaderboards. You agree that the moves of your games may be shown to your opponent, reviewed in the Service and exported as PGN. How your personal data is processed is described in the privacy notice.

7. Intellectual property

The Chesspin name and logo, the characters (Asude, Bobby, Hüma, David, Tuğba, Mustafa and others), the artwork, the text and the design of the Service are ours. You are given a limited, non-transferable licence to use the Service for personal, non-commercial purposes; it does not cover copying, selling or reusing them in another product.

The Service contains open-source components distributed under their own licences, among them the Stockfish chess engine (GPL-3.0), the Lichess puzzle database (CC0) and the piece artwork. Their own licences apply to those components, and these terms do not restrict any right those licences give you. The list is at chesspin.app/lisanslar and in the mobile app under Settings → Open-source licences.

8. Breaking the rules

If these terms are broken, depending on how seriously, we may warn, change a username, correct ratings and XP, restrict access to rated play, suspend an account temporarily or close it. If you think a decision was wrong, write to kvkk@chesspin.app.

9. Closing an account, and the end of the Service

You can delete your account at any time, in the mobile app under Settings → Account or on the website's Account page; what is deleted and what remains is explained on the account deletion page. If we decide to shut the Service down entirely, we will announce it in the Service a reasonable time in advance.

10. Liability

The Service is free and provided "as is". To the extent the law allows, we are not liable for outages, for games lost on time or result because of connection problems, for guest progress kept on a device being lost when the app is uninstalled or browser data is cleared, or for the behaviour of other players. Our liability for harm caused intentionally or by gross negligence, and your statutory rights as a consumer, are not affected.

11. Changes

We may update these terms as the Service changes. The current text is always published on this page, and the date at its top shows the last update. We announce significant changes in the Service before they take effect. Continuing to use the Service after a change means you accept the new terms; if you do not, you can delete your account.

12. Governing law

These terms are governed by the law of the Republic of Türkiye. Your right as a consumer to apply to consumer arbitration committees and consumer courts under Law No. 6502 on Consumer Protection is reserved.
